Welcome to peaksta.com. These Terms of Service (the "Terms") govern your access to and use of our website, products, and services. Please read them carefully. By visiting our site or placing an order, you agree to be bound by these Terms.

Throughout these Terms, "Peaksta", "we", "us", and "our" refer to Peaksta B.V. "You" or "Customer" refers to the visitor or buyer using the site.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

These Terms work together with our other policies. By accepting these Terms, you also accept the following, each of which is available on our website:

To purchase from peaksta.com, you must be at least 18 years old and legally capable of entering into a binding contract under the laws of your country of residence. By placing an order, you confirm that this is the case.

We may, at our discretion, refuse service or cancel orders where we have reason to believe the buyer does not meet these requirements.


4. Products

We have made every effort to display the colours, materials, and details of our products as accurately as possible. However, we cannot guarantee that the colour shown on your screen exactly matches the actual product, as this depends on your device's display settings.

All product descriptions, specifications, and images are provided for general information. Minor variations in stitching, finish, or shade may occur and are not considered defects.

We reserve the right to:

  • Limit the quantities of any product available for purchase
  • Discontinue any product at any time
  • Refuse or cancel orders where we suspect fraud, resale, or violation of these Terms
  • Limit sales to specific regions, jurisdictions, or persons on a case-by-case basis

5. Product Use, Safety, and Assumption of Risk

Peaksta products incorporate features designed to deter opportunistic theft, pickpocketing, slashing, and unauthorised access to your belongings. These features include reinforced materials, locking mechanisms, hidden compartments, RFID-blocking technology, and other anti-theft elements depending on the specific product.

By purchasing and using a Peaksta product, you acknowledge and agree that:

  • No bag, accessory, or security product can guarantee absolute protection against theft, robbery, loss of belongings, financial loss, or personal harm. Anti-theft features are designed to reduce risk and deter opportunistic incidents. They are not guarantees of safety, security, or prevention.

  • You remain solely responsible for your own personal safety, the safety of your belongings, your awareness of your surroundings, and your judgment in any situation involving real or potential risk.

  • You are responsible for using the product as intended, inspecting it for wear, damage, or compromised components before each use, and discontinuing use if any defect, fault, or weakness is observed.

  • You should not rely on a Peaksta product as your sole means of protection against theft, injury, or any other harm. Personal vigilance, situational awareness, and sound judgment remain essential.

  • Peaksta makes no warranty or representation that the use of its products will prevent theft, injury, financial loss, identity theft, data interception, or any other harm, and disclaims any such warranty to the maximum extent permitted by applicable law.

You voluntarily assume all risks associated with the use of Peaksta products, including but not limited to risks arising from theft, robbery, loss, exposure to weather, wear and tear, and ordinary use of the product in your daily activities.

This section does not exclude or limit liability for death or personal injury caused by Peaksta's negligence, for fraud, or for any other liability that cannot be excluded under applicable consumer protection or product liability law.


6. Pricing, Currency, and Taxes

Prices are displayed on the website in the currency selected at checkout. The currency you see may be set automatically based on your location or selected manually.

United States customers: The price shown on product pages does not include sales tax. Applicable state and local sales tax is calculated at checkout based on your shipping address and shown as a separate line item before you complete your purchase.

All other customers: Prices displayed include applicable taxes where required by local law. For international shipments, any import duties, customs fees, or additional taxes imposed by your country at the point of import are your responsibility. See our Shipping Policy for full details on customs and duties.

Prices are subject to change at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout.

In the rare event that a price is shown incorrectly due to a typographical, system, or pricing error, we reserve the right to cancel the order and refund any payment made, even after order confirmation.


7. Orders and Order Acceptance

When you place an order through our website, you make an offer to buy the products in your cart at the price and on the terms displayed at checkout.

A confirmation email is sent automatically once your order is received. This email confirms that we have received your order, but does not yet constitute acceptance of it. The contract between you and Peaksta B.V. is concluded when we send you a separate shipping confirmation email indicating that your order has been dispatched.

We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of:

  • Suspected fraud or unauthorised payment
  • Product unavailability
  • Pricing or description errors
  • Shipping address restrictions
  • Orders that appear to be from resellers or distributors
  • Repeated abuse of our return or refund policies

If we cancel an order after payment has been taken, we will refund the full amount paid using the original payment method.


8. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and order cancellations are governed by our Returns and Refunds Policy, which sets out the procedures, timeframes, condition requirements, and any non-returnable items. Please refer to that policy for the applicable terms in your jurisdiction.

In addition to our standard return policy, certain consumers have statutory rights under local law that cannot be waived. For example, consumers resident in the European Union and the United Kingdom have a statutory right to withdraw from a distance purchase within 14 days of receiving the goods, without giving a reason. To exercise such rights, contact hello@peaksta.com within the applicable period with your order number and a clear statement of your intent.

Where statutory rights apply, items must be returned in unused condition with original packaging. Return shipping costs are borne by the customer unless otherwise stated. Refunds will be processed within the period required by applicable law.


9. Shipping and Delivery

Shipping times, costs, processing windows, customs handling, lost or damaged packages, and address-related responsibilities are all covered in our Shipping Policy, which forms part of these Terms.

Risk of loss and damage to the goods passes to you upon delivery to the address provided at checkout, except where applicable consumer law states otherwise.


10. Account Information and Accuracy

You agree to provide current, complete, and accurate information when placing an order, including your shipping address, email address, and payment details. You are responsible for keeping this information up to date and for any consequences of providing incorrect or outdated information.

We reserve the right to refuse, cancel, or modify orders where the information provided appears to be inaccurate, incomplete, or fraudulent.


11. Intellectual Property: Trademarks

PEAKSTA® is a registered trademark owned exclusively by Peaksta B.V. It is protected under the following registrations:

  • Benelux Office for Intellectual Property (BOIP) — Registration No. 1512673
  • United States Patent and Trademark Office (USPTO) — Serial No. 98726683
  • World Intellectual Property Organization (WIPO), International Registration under the Madrid Protocol — No. 1822547, designating the United Kingdom and the People's Republic of China

Peaksta B.V. retains all exclusive rights to use the PEAKSTA trademark in connection with its goods and services in the jurisdictions listed above and any future jurisdictions in which the mark is registered.

Any unauthorised use, reproduction, imitation, or registration of the PEAKSTA trademark, or of any mark, logo, or name that is confusingly similar, is strictly prohibited. Prohibited use includes, but is not limited to:

  • Selling counterfeit or unauthorised products under the PEAKSTA name
  • Using the PEAKSTA name or logo in advertising, marketplaces, social media, or domain names without written permission
  • Registering similar marks, handles, or domain names that may cause consumer confusion
  • Importing, distributing, or reselling unauthorised products bearing the PEAKSTA mark

Peaksta B.V. actively monitors for infringement and will take legal and platform-level enforcement action against any unauthorised use, including but not limited to cease and desist proceedings, marketplace takedown requests (Amazon, eBay, Fruugo, TikTok Shop, Shopee, Lazada, and others), customs seizures, and litigation in any competent jurisdiction.

12. Intellectual Property: Copyright and Other Rights

All content on peaksta.com, including text, photography, video, graphics, illustrations, product designs, logos, page layouts, and code, is the property of Peaksta B.V. or its licensors and is protected by copyright, design rights, and other intellectual property laws.

You may view and use the website content for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, publish, scrape, transmit, or create derivative works from any content on the site without our prior written permission.

Limited fair use, such as quoting a product review or sharing a public social media post we have published, is permitted in line with applicable law.


13. User Comments, Reviews, and Submissions

If you submit comments, reviews, photos, suggestions, or other content to us, whether through the website, email, social media, or third-party platforms, you grant Peaksta B.V. a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit, adapt, publish, and distribute that content in any medium and for any purpose, including marketing.

You confirm that any content you submit:

  • Is your own original work or that you have the right to share it
  • Does not infringe the rights of any third party
  • Does not contain unlawful, defamatory, obscene, harassing, or misleading material
  • Does not contain viruses or other harmful code

We may, but are not obligated to, monitor, edit, or remove submissions at our sole discretion. We are not responsible for content submitted by users.


14. Personal Information and Data Protection

16. Prohibited Uses

You may not use the website or our products:

18. Limitation of Liability

To the maximum extent permitted by applicable law, Peaksta B.V., its directors, officers, employees, agents, suppliers, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of profits, revenue, savings, or business opportunity
  • Loss of data or replacement costs
  • Loss of property, belongings, or personal effects, including theft, robbery, or loss of items carried in or with a Peaksta product
  • Identity theft, financial loss, or unauthorised access to personal information
  • Emotional distress, inconvenience, or reputational harm

This limitation applies whether the claim is based in contract, tort (including negligence), strict liability, product liability, breach of warranty, or any other legal theory, and whether or not Peaksta B.V. has been advised of the possibility of such damages.

In no event shall the total aggregate liability of Peaksta B.V. to you, for any and all claims arising under or in connection with these Terms, your purchase, or your use of any Peaksta product, exceed the total amount paid by you for the specific product giving rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by Peaksta's negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law. Mandatory consumer protection rights remain unaffected.


19. Class Action Waiver (United States Customers)

This section applies only to customers resident in the United States.

To the maximum extent permitted by applicable US federal and state law, you and Peaksta B.V. agree that any dispute, claim, or controversy arising out of or relating to your purchase, your use of the website, or these Terms shall be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, mass, or representative action.

You expressly waive your right to participate in any class action lawsuit, class-wide arbitration, private attorney general action, or any other consolidated proceeding against Peaksta B.V.

This waiver does not apply to customers outside the United States. If a court of competent jurisdiction determines that this class action waiver is unenforceable in any particular case, the remainder of these Terms shall remain in full force and effect, and the dispute shall be resolved on an individual basis to the maximum extent permitted by law.


20. Time Limit for Claims

To the maximum extent permitted by applicable law, any claim or cause of action arising out of or relating to your purchase, your use of the website, or these Terms must be filed within one (1) year after the cause of action accrues. Any claim not brought within this period is permanently barred.

This time limit does not apply where it is shorter than the minimum statutory period in your jurisdiction, in which case the statutory minimum applies.


21. Indemnification

You agree to indemnify and hold harmless Peaksta B.V., its affiliates, officers, directors, employees, agents, suppliers, and service providers from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms
  • Your violation of any law or the rights of a third party
  • Your misuse of the website, products, or services
  • Your use of a Peaksta product in a manner inconsistent with the intended purpose, instructions, or warnings provided

This obligation survives termination of these Terms.


22. Force Majeure

Peaksta B.V. shall not be liable for any failure or delay in performance under these Terms caused by events beyond its reasonable control, including but not limited to:

  • Acts of God, natural disasters, severe weather, fires, or floods
  • War, civil unrest, terrorism, or government action
  • Pandemics, epidemics, or public health emergencies
  • Strikes, labour disputes, or transportation disruptions
  • Customs holds, border closures, or trade restrictions
  • Failures or interruptions of internet, hosting, or payment services
  • Supply chain disruptions affecting raw materials or manufacturing

In such cases, our obligations under these Terms will be suspended for the duration of the event, and we will resume performance as soon as reasonably possible.


23. Termination

These Terms remain in effect until terminated by either party.

You may terminate these Terms at any time by ceasing to use the website. We may terminate or suspend your access to the website and our services at any time, without notice, if we believe you have breached these Terms or applicable law. Termination does not affect any rights, obligations, or liabilities that arose before the date of termination.


24. Governing Law

These Terms and any contract concluded between you and Peaksta B.V. are governed by and construed in accordance with the laws of the Netherlands, excluding its conflict of laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

This choice of law does not deprive consumers of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.


25. Dispute Resolution

We aim to resolve any complaint or dispute as quickly and fairly as possible. Before taking any formal action, please contact us at hello@peaksta.com with a clear description of the issue, your order number, and the outcome you are seeking. We commit to responding within 14 days and to working in good faith toward an informal resolution.

If a dispute cannot be resolved informally, the competent courts of the Netherlands shall have exclusive jurisdiction, except where Peaksta B.V. brings proceedings in the courts of the country where the customer is domiciled.

Consumers retain the right to bring proceedings before the courts of their country of residence under the mandatory consumer protection rules of that country. Consumers in the European Union may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

Nothing in this section limits Peaksta B.V.'s right to seek injunctive or equitable relief in any competent court to protect its intellectual property rights.


26. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.


27. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Returns and Refunds Policy, and any other policy referenced on the website, constitute the entire agreement between you and Peaksta B.V. regarding your use of the website and your purchases, and supersede any prior agreements or communications.

The failure of Peaksta B.V. to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.


28. Changes to These Terms

We reserve the right to update or modify these Terms at any time by posting the revised version on this page with a new "Last updated" date. Material changes will be communicated through our website or by email where appropriate.

It is your responsibility to review these Terms periodically. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
